RYDAR TERMS AND CONDITIONS OF USE
These Terms and Conditions regulate the access, navigation and use of the RYDAR digital platform, an application operated by Motopark SRL, domiciled in La Molina, Lima, Peru. Access to and use of the platform implies the express, full and mandatory acceptance of these conditions.
1. Definitions
For the purposes of this document, "RYDAR" shall be understood as the digital platform and mobile application; "User" or "Rider" means a person registered on the platform; "Provider" means an affiliated establishment or service provider; "Platform": technological environment operated by Motopark SRL.
2. Purpose of the Platform
RYDAR is a technological platform aimed at connecting motorcyclists (Riders) and service providers related to motorcycling, through digital interaction tools including road support, geolocation, messaging, networking, social content and access to third-party services. RYDAR seeks to facilitate the connection between local Riders and Riders on the road; access to specialized Providers; exchange of information; collaborative assistance; community content; Premium functionalities related to security and connectivity.
3. Legal Capacity and Minimum Age
Use of the platform is restricted exclusively to persons over the age of eighteen (18) with sufficient legal capacity in accordance with applicable law.
4. User Registration
To access certain functionalities, the user must complete the registration process by providing truthful, up-to-date and complete information. Motopark SRL may suspend or terminate accounts with false, inaccurate or suspicious information; You may request additional validations of identity, phone, email, or other reasonable information. Each user is responsible for the confidentiality of their account, their password, the activities carried out from their profile, any interaction derived from the use of the platform. The user must immediately notify any unauthorized use.
5. Platform functionalities
The platform may include functionalities such as approximate geolocation, private messaging, groups, publications, uploading images and multimedia content, connection through WhatsApp, Social Feed, shared location and other related digital services.
6. Geolocation and Location Sharing
The platform uses geolocation information to facilitate connections between users and nearby providers. The location shown will be approximate by default. The exact location will only be shared when the user gives express and specific consent. The user authorizes the processing of location information to: display nearby Riders; facilitate connections; improve functionalities; enable security tools; Operate premium services. The "Location sharing" function allows you to temporarily share your location with contacts authorized by the user, being able to activate or deactivate the function; select recipients; define access duration; Cancel access at any time. Use of this feature implies express consent. RYDAR, however, does not guarantee absolute accuracy of geolocation.
7. Privacy Features
RYDAR adopts a user-configurable privacy model, which may enable privacy features such as visible, Ghost Mode, Offline Mode, or other settings intended to limit your visibility within the platform. RYDAR facilitates voluntary referrals to external services such as Whatsapp, with the exchange of telephone numbers being optional and voluntary to be carried out through the express action of the user. The platform does not control external services or their privacy policies. RYDAR offers a "Feed" space for the exchange of content such as texts, images, comments, routes, recommendations, multimedia content that is accessed by subscription. The user retains ownership of their content, but grants RYDAR a non-exclusive license to display it within the platform. RYDAR may moderate, hide, or remove content that is offensive, illegal, infringes rights, affects the community, and poses security risks whenever it can detect them.
8. Permitted Use
The user undertakes to use the platform in a lawful, ethical and respectful manner. It is forbidden to use RYDAR for purposes that are illegal, fraudulent, defamatory, offensive, discriminatory or that may endanger the safety of third parties.
9. Third-Party Providers and Services
Providers may be subjected to basic processes of validation of identity, commercial existence, RUC, contact data and digital presence. Such validation does not constitute a guarantee, certification, recommendation or absolute endorsement regarding the quality, compliance, licenses, security or legality of the services offered. Any contracting or commercial interaction between users and Providers will be the sole responsibility of the parties involved.
10. Subscriptions and Payments
RYDAR may offer free services and premium features through monthly or annual subscriptions. During certain stages of the project, payments may be processed through external third-party platforms. The terms and conditions may be changed at any time.
11. Refund Policy
Subscriptions and payments made will not be refundable, unless cancellation request is submitted within three (3) calendar days after contracting.
12. Intellectual Property
All rights related to the platform, including software, design, interfaces, logos, trademarks, content and documentation, belong to Motopark SRL or their respective owners and are protected by applicable legislation.
13. User-Generated Content
Each user will be solely responsible for the content they publish, share or transmit through the platform. Motopark SRL may remove content that it considers inappropriate or contrary to these conditions.
14. Limitation of Liability
RYDAR acts exclusively as a technological platform for intermediation and connection, not a security, transportation, escort or police verification service. Motopark SRL will not be responsible for accidents, theft, personal injury, economic losses, conduct of third parties, physical encounters, deficient services of Providers or for any situation arising from the use of the platform as well as does not guarantee: identity of users; conduct of third parties; accuracy of information; continuous availability; absence of errors; results derived from connections made. Motopark SRL will not be responsible for indirect damages, economic losses, incidents between users, theft, accidents, personal injuries, activities of third parties. Without detriment to good faith in making commercial contacts and support en route, any physical meeting, accompaniment, assistance en route or interaction outside the platform will be carried out under the exclusive responsibility of the users involved. It is recommended to adopt reasonable personal security measures.
15. Digital Security
Motopark SRL will implement reasonable computer security measures; However, the user acknowledges that no digital system is completely secure or infallible, no digital transmission guarantees absolute protection, interruptions or external breaches may occur.
16. Suspension and Termination of Accounts
Motopark SRL may suspend, restrict, block or delete user accounts, content that violates these terms or represents a risk to the community or the platform. It is strictly forbidden: harassing users; Engage in unauthorized tracking; using the platform for criminal activities; collect information without consent; create fake profiles; impersonate identity; post discriminatory content; use bots or automations; breach security systems; Engage in spam or unauthorized advertising.
17. Modifications
Motopark SRL may modify these Terms and Conditions at any time. Continued use of the platform will imply acceptance of the modifications.
18. Intellectual Property
The RYDAR brand, designs, logos, interfaces and technological developments are the property of Motopark SRL or its licensors, duly registered with Indecopi. Unauthorized reproduction is prohibited.
19. Governing Law and Jurisdiction
These terms are governed by the laws of the Republic of Peru. Any dispute shall be submitted to the jurisdiction of the competent courts of Lima, Peru.

RYDAR PRIVACY POLICY AND PROCESSING OF PERSONAL DATA
This Privacy Policy regulates the processing of personal data carried out by Motopark SRL through the RYDAR platform, in accordance with Law No. 29733 – Personal Data Protection Law of Peru and other applicable regulations.
1. Data Controller
The controller of personal data is Motopark SRL, domiciled in La Molina, Lima, Peru.
2. Personal Data Collected
The platform may collect information such as name, email, phone, photograph, language, motorcycle model, license plate, location, WhatsApp data under consent, published content and technical usage data.
The information may be collected during registration, through forms, by interaction within the app, by authorized geolocation, by cookies and analytics, by technical support, by voluntary integration with external services.
3. Purposes of the Processing
Personal data will be processed to operate the platform, facilitate connections between users and providers, improve the digital experience, provide support, prevent fraud, improve functionalities, perform statistical analysis and send communications related to the service.
4. Geolocation
RYDAR uses geolocation to facilitate functions related to proximity, connectivity and services available en route. The visible location will be approximated by default and the exact location will only be shared with the express consent of the user. The user will be able to control the level of visibility, geolocation activation, visible status, Ghost Mode, Offline. The location sharing feature with trusted contacts outside of the RYDAR app will allow you to share exact temporal location, define authorized contacts, set duration, and revoke permissions at any time using the control in the registration profile.
5. Whatsapp and external services
The platform will be able to facilitate voluntary integration with external applications. RYDAR CONNECT does not control the policies or security of third-party platforms.
6. Feed and community content
Posts made may be visible to other users according to privacy settings. The user is responsible for the content he or she posts. When you join the RYDAR community, your profile and activities will be set to be visible to everyone by default. Your name, profile information, photos, videos, routes, members you follow, members who follow you, and the vehicles you use on RYDAR may be viewed by other RYDAR members or on public RYDAR pages, unless you modify your settings to restrict such disclosure. RYDAR offers the option that allows you to limit the disclosure of some of this information.
7. Providers
Providers will be able to view information necessary for commercial interaction authorized by the user. RYDAR CONNECT does not sell private user information.
8. Tech Tools
The platform may use firebase, cookies, Google Analytics, Meta Pixel, technical logs, usage metrics, device identifiers. This will improve stability, optimize experience, prevent abuse and detect errors.
9. Location in the background
The app will be able to use location services in the background when the user grants specific permissions from their mobile device.
10. Consent
The user authorises the processing of their personal data by expressly accepting this policy and the permissions requested by the application.
11. Information Sharing
Motopark SRL does not sell personal data. Certain technology providers linked to the operation of the platform may process information strictly necessary to provide their services.
12. Information Security
Motopark SRL implements reasonable technical, organisational and administrative measures to protect personal data against unauthorised access, loss, alteration or improper disclosure. However, no system can guarantee absolute security against external attacks, unauthorized access, technological failures.
13. Data Retention
Personal data will be kept for the time necessary to fulfill the purposes described or as long as there is an active relationship with the user such as security, operation, legal compliance, fraud prevention and technical support.
14. Rights of the Owner
The user may exercise their rights of access, rectification, cancellation, revocation, deletion, opposition and other rights recognized by applicable legislation by means of a request sent to the official contact email.
15. Communications and Marketing
RYDAR may send notifications, promotional messages, newsletters and communications linked to the platform. The user may manage their communication preferences from the application or upon express request.
16. International Data Transfer
Due to the digital and international nature of the platform, certain technological services could process information outside Peruvian territory. RYDAR may use technological infrastructure and providers located outside the User's country of residence.
17. Minors
The platform is not directed to minors and does not knowingly collect information from persons under the age of eighteen (18).
18. Modifications to the Policy
Motopark SRL may update this policy at any time. The modifications will be published within the platform.
